Waiver & Release of Liability Agreement

By signing this waiver, I acknowledge that I am voluntarily participating in the Workshop: Dynamic Birdwatching at Maui Bird House, which is hosted outdoors at a private residence and nature retreat in a rural area of Maui. I understand and agree to the following:

1. Assumption of Risk

I understand that the workshop takes place in a rural, natural environment on private property. This includes but is not limited to:

Uneven and sloped terrain, including steep areas.
Presence of animals on the property, including dogs, cats, chickens, and wild birds, which may present a risk of accidental injury or allergic reactions.
Outdoor exposure to natural elements such as weather, insects, and other wildlife.
Participation in activities involving the provision and consumption of food, which may present a risk of food allergies or adverse reactions.

I am aware that Kula Hospital is located approximately 15 minutes away and provides limited services. Maui Memorial Hospital, with more comprehensive services, is approximately 45 minutes by car from the retreat.

I assume full responsibility for any injuries, illness, or damages that I may sustain as a result of participating in the workshop, including those that may arise from the natural conditions or animals on the property.

2. Medical Fitness and Allergies

I confirm that I am physically capable of participating in outdoor activities and walking on uneven terrain. I have disclosed any relevant medical conditions, allergies (including food allergies), or physical limitations to the workshop organizers.

I understand that no medical personnel are present on-site, and I am responsible for any medical needs or emergencies that may arise during the workshop.

3. Release of Liability

I, on behalf of myself, my heirs, executors, and assigns, release and hold harmless Maui Bird House LLC, its owners, employees, agents, and affiliates from any and all claims, liabilities, or damages arising from my participation in the birdwatching workshop, including, but not limited to, injury, illness, death, or property damage, whether caused by negligence or otherwise.

4. Indemnification

I agree to indemnify and defend Maui Bird House LLC, its owners, employees, agents, and affiliates from any claims, damages, or liabilities arising out of my participation in the workshop or the actions of animals or other participants on the property.

5. Photo and Media Release

I understand that photographs or videos may be taken during the workshop for promotional purposes. I grant permission for my likeness to be used in these materials unless I have provided a written request otherwise.

6. Governing Law

This agreement shall be governed by and construed in accordance with the laws of the State of Hawaii.
